These Terms & Conditions ("Terms") govern your use of the website and online shop operated by Yakagoya ("we," "us," or "our"). By accessing or using this website, you agree to be bound by these Terms.

2. Eligibility and conditions of use

You must be at least 18 years of age to use this website and to purchase products from us. By accessing this website or placing an order, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding contract.

Yakagoya does not sell products to minors. Any orders placed by individuals under the age of 18 may be canceled at our sole discretion.

Parents or legal guardians are solely responsible for preventing minors from accessing or using the products purchased from this website.

 

You agree to use this website in compliance with all applicable laws and regulations.

The following actions are prohibited:

  • Placing orders using false or misleading information

  • Unauthorized access or actions that interfere with the operation of this website

  • Infringing upon the rights or interests of third parties or our company
     

3. Product Sales and Contract Formation

  • A sales contract is formed when we accept your order and send you an order confirmation.

7. Product Use and Safety

  • Products provided by us must be used only for their intended purpose and in accordance with proper usage instructions.

  • Before using any product, please review our Important Safety Instructions for Equipment.

  • We are not responsible for any damage or injury caused by improper use, modification, or use outside the intended scope.

  • The customer explicitly acknowledges and agrees that all products are used entirely at the customer’s own risk, and that our Important Safety Instructions for Equipment are incorporated into these Terms by reference. Furthermore, the customer agrees that any deviation from the provided instructions or any modification, misuse, or unsafe handling of the products completely releases Yakagoya from any liability, including but not limited to personal injury, property damage, or any other loss.
     

8. Limited Warranty

Yakagoya provides a limited warranty that the products sold are free from defects in materials and workmanship at the time of shipment.

This limited warranty applies only to the original purchaser and is valid for 14 days from the date of delivery, provided that the product has been used only for its intended purpose and in accordance with the provided instructions.

This limited warranty does not cover damage or failure resulting from misuse, modification, improper handling, normal wear and tear, accidents, or use outside the intended scope.

The sole and exclusive remedy under this limited warranty shall be, at our discretion, repair, replacement, or refund in accordance with our Return & Refund Policy.

To the maximum extent permitted by law, all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, are hereby disclaimed. For all matters not explicitly covered by this Limited Warranty, the terms of our Disclaimer apply.

9. Disclaimer

The products sold on this website are traditional Kyudo (Japanese archery) equipment intended for use by trained and experienced practitioners. Proper knowledge, skill, supervision, and adherence to all provided safety instructions are required for safe use. Improper use, misuse, modification, or failure to follow instructions may result in serious personal injury, death, or property damage. Except as explicitly provided in our Limited Warranty, YAKAGOYA disclaims any and all liabilities or warranties not covered therein.

To the fullest extent permitted by applicable law, YAKAGOYA expressly disclaims any and all warranties, representations, or conditions, whether express or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in the Limited Warranty.

To the maximum extent permitted by law, YAKAGOYA shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use, misuse, inability to use, or performance of the products, including but not limited to personal injury, death, property damage, loss of use, or economic loss, even if YAKAGOYA has been advised of the possibility of such damages.

The Limited Warranty provided by YAKAGOYA constitutes the sole and exclusive warranty applicable to the products, and the remedies set forth therein are the customer’s sole and exclusive remedies.
 

10. Limitation of Liability

In no event shall our liability exceed the total amount actually paid by the customer for the applicable product.
 

11. Intellectual Property

All content on this website, including text, images, designs, and logos, is the property of Yakagoya or its rightful owners and may not be used without permission.
 

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will become effective upon posting on this website.
 

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising out of or relating to these Terms or the use of this website shall be subject to the exclusive jurisdiction of the courts located within the State of California.
